Illegal downloads, the winner is...

Which country is the champion of illegal downloads ?  This is a common question nowadays and many things have been said, and their contrary as well.

It has been said that France would have been the champion of illegal downloads these last years (the law Hadopi arrived to save the entertainment industry), but according to certain sources, less than 1 french connected to the internet out of 5 would download music & films illegally, just like in United States or United Kingdom.

China would be the real champion of illegal downloads with more than 3 chinese people connected out of 4, followed by Russia, India, Spain, Brazil...

There is no easy way to verify such numbers but as direct downloads, most probably of copyrighted music & films, from sites like Megauplod, Rapidshare, Uploading.to, Hotfiles (and so on) are now more and more popular, you may have an idea (but for China which is a special case due to internet filters most probably applied by the government) by looking these Traffic stats by country provided by the Alexa toolbar :

Of course you may look at the traffic stats for every website that is about direct downloads or P2P. These numbers should be taken with moderation, everyone do not use the Alexa toolbar, but these numbers give undoubtly a clue on which country uses these websites most.

As for me, the conclusion I would roughly make while taking account of what internet looks like & the people in each country is that the number of direct downloads in United States, China or France, is basically the same in percentage !

Quel pays est le champion du piratage et plus précisément du téléchargement illégal ?  La question a souvent été posée depuis quelques années et on a entendu tout et son contraire.

Il a été dit que la France avait été le pays champion du téléchargement illégal (avant que la loi Hadopi n'arrive pour sauver l'industrie du divertissement), mais selon certaines sources il n'en serait rien, moins d'un français sur 5 téléchargerait illégalement alors que plus de 3 chinois sur 4 le feraient, rien de forcément étonnant pour le pays champion de la contrefaçon.

La Chine serait ainsi suivi de la Russie, de l'Inde, de l'Espagne et du Brésil.

Il n'y a pas de moyen facile de vérifier de tels chiffres, mais à l'heure des téléchargements directs, de plus en plus populaires, à partir des sites Rapidshare, Megaupload, Hotfile, Uploading.to et ainsi de suite, certains chiffres peuvent nous donner une idée sur la question, notamment les statistiques de traffic en provenance du site Alexa (sauf peut-être pour la Chine, où le gouvernement applique sans doute des filtres pour de nombreux sites web) :

Tout le monde n'utilise bien sûr pas la barre d'outils Alexa, mais ces chiffres laissent à penser grosso modo et en tenant compte de ce à quoi ressemble le paysage internet et de la population dans chaque pays que tout le monde effectue des téléchargements directs à peu près dans les mêmes proportions en Chine, aux Etats-Unis ou en France, et bien entendu d'oeuvres protégées dans la plupart des cas.

David Carradine dies at 72

David Carradine was for most of us (at least those aged of 35 years and more) "Kung Fu". He also appeared in Kill Bill with Uma Thurman by Quentin Tarantino and in about 100 other movies. His death is quite a surprise today as he was not so old, he would probably have had a great and wise quote about his own death.

David Carradine était pour la plupart d'entre nous agés de plus de 35 ans l'acteur de la mythique série des années 70 "Kung Fu". Il a également joué dans le deuxième volet de Kill Bill de Quentin Tarantino avec Uma Thurman et dans une centaine d'autres films, environ 166 heures de programmes télévisuels au total. Oscars, Césars 2009

After the Oscars ceremony, here are the Césars in France, that should see the victory of Mesrine with Vincent Cassel, and remind us the death this year of several well known celebrities like Claude Berri and Guillaume Depardieu. Dany Boon (actor, director, co-producer of "Bienvenue chez les ch'tis") shouldn't be at the ceremony as his film was only nominated once this year.

As a reminder Dany Boon would have earned in 2009 at least 26 million Euros after the success of his film seen by more than 20 million people in french theaters. At a first sight, this astronomic number may be compared to american film stars, but that's not so simple as Dany Boon was not only an actor in this great comedy.

A peine la cérémonie des Oscars terminée, la France se met à l'heure des Césars, qui devrait voir cette année la victoire entre autres de la grosse production française de l'année "Mesrine" avec Vincent Cassel, et nous rappeler au passage la disparition de célébrités come Claude Berri et Guillaume Depardieu. Dany Boon (acteur, réalisateur et co-producteur de "Bienvenue chez les ch'tis") ne devrait pas être présent à la cérémonie après que son film n'ait été nominé qu'une seule fois cette année.

La nouvelle est tombée cette semaine, Dany Boon aurait gagné plus de 26 millions d'euros en 2009 après le succès fulgurant de son film, vu par plus de 20 millions de français dans les salles. A première vue, ce chiffre astronomique pourrait être comparé sans difficultés aux salaires des plus grandes stars américaines mais ce n'est évidemment pas aussi simple étant donné la triple casquette de Dany Boon dans cette magnifique comédie.

Facebook terms of use

This month, an enormous buzz has been created around Facebook's terms of use, each day we see a new group inside Facebook around this topic, but is there any reason for this ?

Like any other successful creation, Facebook has to face jealousy & imitations but this may be the way internet goes only : A few weblogs will always find a "Da Vinci Code"-like way to reveal a new 'scandal'. Facebook is the perfect victim, it most probably has lawyers who write as perfect as possible terms & conditions of use but it firstly has to protect itself when the principle of the website creates obvious problems by its content, mainly made of personal content.

The Facebook's terms of use :
You hereby grant Facebook an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to (a) use, copy, publish, stream, store, retain, publicly perform or display, transmit, scan, reformat, modify, edit, frame, translate, excerpt, adapt, create derivative works and distribute (through multiple tiers), any User Content you (i) Post on or in connection with the Facebook Service or the promotion thereof subject only to your privacy settings or (ii) enable a user to Post, including by offering a Share Link on your website and (b) to use your name, likeness and image for any purpose, including commercial or advertising, each of (a) and (b) on or in connection with the Facebook Service or the promotion thereof.

Only one line deleted was enough to create the buzz :
You may remove your User Content from the Site at any time. If you choose to remove your User Content, the license granted above will automatically expire, however you acknowledge that the Company may retain archived copies of your User Content.

Such titles then appeared in well known websites & newspapers and Facebook had to react quickly :

"Do you belong to Facebook, forever?" [Chicago Tribune]

"Facebook: "We have never claimed ownership" of members' content" [The Standard]

Quite funny after all, just one more viral hoax... Do you really think that Facebook would suicide by using any bad way your personal informations ?  As for me I don't think so. Of course Facebook has to make money, it still loses several million dollars, but I have no doubt they will find a correct way.

Ce mois-ci, le buzz tourne à nouveau indéniablement autour de Facebook, le plus incontournable des réseaux sociaux. Le problème vient de ses termes et conditions d'utilisations, que certains sites n'hésitent pas à dénoncer dès lors que la moindre ligne change. Il est vrai que la question des données personnelles a toujours été et restera sensible tant internet s'est emparé de nos vies privées.

Pas un jour ne passe sans que se crée un nouveau groupe sur Facebook dénonçant ce genre de dangers et le principe même du site. Alors, Facebook victime de son succès, de la jalousie, de ses concurrents, ou est-ce simplement comme cela que fonctionne désormais internet ?

Faire du "buzz" est évidemment le moyen le plus sûr de rentabiliser un journal ou un site web, et certains n'hésiteront pas à trouver des défauts à quiconque en fait (façon pratique d'emprunter un peu de sa popularité), défauts démontrés par A+B façon "Da Vinci Code" là où bien sûr il n'y a souvent rien à trouver. Qui peut imaginer que Facebook ira utiliser des données personnelles d'une façon nuisible ?  Ce serait tuer la poule aux oeufs d'or, il n'y a aucun intérêt à cela. Bien entendu Facebook a un sérieux problème, il n'est pas encore rentable, mais la société vaut plus d'un milliard de dollars, nul doute qu'ils trouveront un moyen, ce n'est qu'une question de temps.

After the rings affair (Nicolas Sarkozy would have offered the same ring from Christion Dior to his ex-wife Cécila and to Carla Bruni), today Cécila would have tried to block the publication of a book that quotes her describing Nicolas Sarkozy as a seducer incapable of loving anyone, even his children.
